Did Fox steal Arcade Fire music for an NFL commercial?

Well this is interesting, given the uproar and shenanigans large media companies tend to make about, for example, YouTube users nicking their content. Pitchfork reports that Saturday's Superbowl (it's like a football match, UK folk, but flashier) saw an advert for the NFL which apparently used music by Arcade Fire - "No Cars Go" - without the band's permission.
Now, you have to assume the band's representatives are telling the truth, and that they're not cashing in on the quiet. Which begs the question - how can Fox do this? Will they get away with it? And if they do, does that mean people can start uploading episodes of The Simpsons to YouTube?
